Ten Summit County property owners are challenging the constitutionality of municipal incorporations in a lawsuit filed this week naming Lt. Gov. Deidre Henderson, the state Legislature and West Hills town sponsor Derek Anderson as defendants.        

The lawsuit to block Summit County's newest town, if successful, could reshape incorporation statewide. The 10 landowners and residents suing town sponsor and real estate attorney Derek Anderson, Lt. Gov. Deidre Henderson and the Utah Legislature claim the current process to form a new town violates the Utah Constitution.        

Grassroots group formed in March to protect the farmland, history and rural character in eastern Summit County.        

City councilmembers passed a resolution opposing West Hills, the town proposed along state Route 248. Kamas’ mayor and city council say they hope it leaves no doubt about what they want to happen on the town’s western front.        

Kamas Valley Preservation Association says its mission is broader than simply opposing the proposed town. The nonprofit's mission is to protect southern Summit County’s natural beauty and agricultural lifestyle, according to its website.

West Hills, located between Kamas and Hideout, has cleared a major hurdle in its push for incorporation after enough voters and landowners signed a petition submitted to the state on Jan. 16.        

Summit County Community Development Director Peter Barnes has an update on development projects throughout the county including the status of the West Hills town proposal and Canyons' parking garage and slopeside housing construction.

Vocal opposition struck a neutral consultant as "different" from other incorporations he's worked on. Dozens of Kamas Valley residents attended Monday night's hearing, and those who spoke ranged from skeptical to downright angry and opposed to West Hills.        

Eastern Summit County community members showed up in force to the second West Hills public hearing on Monday to express displeasure with the proposed township bordering Kamas and Wasatch County and question the sponsor’s motives.
